  • Conference "The Omnibus law and its consequences for classified establishments"

    To prepare luxembourgish companies, that are subject to the law known as "Commodo", an information session, with the latest news and procedures resulting from this legislation and the publication of the "Omnibus" law, will be held on Wednesday 14 June 2017 at the “Bâtiment administratif” in Belval from 3 to 5 pm.

The classified establishments (according to the Law of 10 July 1999, known as “Commodo”) are subjected to a strict legislation. The “Omnibus” law of 3 March 2017 aiming at administrative simplification, modified the law on classified establishments with effect from 1 April 2017. It changes the transitional provisions to comply with the changes of the nomenclature of 2012 until 1st July 2017 (the initial deadline was the 1st of January 2013). Among the establishment concerned by the changes of the nomenclature of 2012 are, for instance, the establishments storing chemical products, certain craft trades, culture and sports halls and certain agricultural establishments, etc.. Some other changes are related to the documents to provide with an authorization application. To prepare companies for these changes, an information session with the latest news and procedures will be held on Wednesday 14 June 2017 at the “Bâtiment administratif” in Belval from 3 to 5 pm. First, the Environment Agency will describe in detail the changes related to the simplification of the administrative procedures for the Commodo procedures and also for other pieces of environmental legislation. The Luxembourg Institute of Science and Technology (LIST) will present a guide and an Excel tool allowing companies that store chemical products to make an assessment of the impacts of these new requirements for their Commodo authorization, e.g. if a change of the Commodo class and subsequently a modification of the authorization is necessary. Finally, an enterprise having applied the tool developed by LIST will report its experience and give feedback regarding its Commodo compliance, the changes made and its financial impact. This conference is part of the “Betriber & Emwelt” cycle, which provides companies and public actors a series of information sessions on the environmental topics. These sessions are organised by the “Environmental Research and Innovation” (ERIN) department of LIST, jointly with the Environment Agency. You find the annual program here.

Objectives

The objective is to raise awareness of the recent changes regarding the evolution of the Luxembourgish and European regulation:
  1. the modified law of 10 June 1999 relative to the classified establishments in its consolidated version which take into account the grand-ducal regulation of 10 May 2012
  2. the CLP regulation (Regulation (EC) 1272/2008 of 16 December 2008 on the classification, labelling and packaging of substances and mixtures).

Target Audience

This conference mainly addresses companies in the industrial sector (for example enterprises storing chemical products) or craftsmen (for example butchers, car mechanics and workshops, carpenters, roofers, stone masons, metal construction contractors, etc.) falling under the Commodo law.
