Update of the national law on enforcement of REACH and CLP published
On the 21st of May, an update of the Paquet REACH has been updated in the Memorial A of the Grand Duchy of Luxembourg.
This new law (Loi du 16 mai 2019 portant modification de la loi du 16 décembre 2011 concernant l’enregistrement, l’évaluation et l’autorisation des substances chimiques ainsi que la classification, l’étiquetage et l’emballage des substances et mélanges chimiques) updates the provisions on penalties applicable for infringement of the provisions of REACH and CLP. Some articles was only updates with additional provisions and some others totally replaced by new ones.
For example, as a new provision, an administrative penalty of 250 euros to 15 000 euros can be imposed to the economic operator whose labels or packages do not comply with the provisions of CLP and safety data sheets do not comply with the provisions of REACH and specific provision of the national law.
